On May 26, 2022, Alonzo Weekly was pulled over after he drove his SUV over or onto the fog line.  Prior to pulling Weekly over, the law-enforcement officer ran a BMV search and discovered neither of the registered owners possessed a valid driver’s license.  Weekly was charged with operating a vehicle as a habitual traffic offender.  Before trial, Weekly moved to suppress evidence obtained following the traffic stop, arguing the traffic stop was unconstitutional.  The trial court concluded the stop was lawful and denied Weekly’s motion.  During voir dire, Weekly objected to the all-white venire, arguing it was not a jury of his peers because there were no African-American members.  The trial court overruled the objection and Weekly was found guilty as charged.  On appeal, Weekly argues the traffic stop violated his rights under Article 1, Section 11 of the Indiana Constitution.  Weekly also claims his constitutional right to an impartial jury was violated when he was convicted by an all-white jury chosen from an all-white venire.  In response, the State argues the traffic stop was reasonable and Weekly did not present evidence showing African Americans were underrepresented in Miami County jury venires or due to systemic exclusion.
