Anonymous Child brought this action against Anonymous Physician and Anonymous Healthcare Group after Anonymous Child learned through genetic testing that she is the biological child of Anonymous Physician.  Anonymous Physician treated Anonymous Child’s parents for fertility issues in 1985 and was supposed to use sperm from Anonymous Child’s father to inseminate Anonymous Child’s mother.  Anonymous Child learned in 2019 through news reports that Anonymous Physician was accused of using his own sperm to inseminate his patients rather than using third-party donor sperm.  At that time, Anonymous Physician had not been accused of using his own sperm to inseminate patients where the patient’s spouse provided sperm for insemination.  In 2022, Anonymous Child learned through a documentary that Anonymous Physician was also accused of using his own sperm to inseminate patients where the patient’s spouse provided sperm for insemination.  Anonymous Child then obtained genetic testing, which demonstrated that Anonymous Physician is her biological father, and brought this action.  Anonymous Physician and Anonymous Healthcare Group filed a motion for summary judgment and alleged that Anonymous Child’s claims were barred by the statute of limitations.  The trial court granted the motion for summary judgment, and Anonymous Child appeals this decision.  The Indiana Trial Lawyers Association has submitted an amicus curiae brief on appeal in support of Anonymous Child.
