Thompson appeals his convictions and raises one issue: whether the trial court abused its discretion when it admitted evidence that law enforcement officers obtained while executing a search warrant. Specifically, Thompson claims that the search of his residence violated the Fourth Amendment of the United States Constitution and Article 1, Section 11 of the Indiana Constitution because the search warrant was not supported by probable cause. Thompson contends that law enforcement officers intentionally included patently false facts in the probable cause affidavit. In response, the State argues that law enforcement officers did not knowingly mislead the court when including an inaccurate fact in the affidavit, and that the remaining information recounted in the probable cause affidavit was sufficient to support a finding of probable cause.
The scheduled panelists are Judge Mathias, Judge Kenworthy, and Judge Felix.
