Daly Self-Directed Individual Retirement Account (“the Daly IRA”) (collectively, “the Daly Parties”), entered into various business arrangements (including the formation of West 32) that ended badly, resulting in litigation and a judgment and award of attorney’s fees in favor of the Daly Parties. The Dalton Parties argue that the trial court erred in concluding that (1) Edgerock had breached West 32’s operating agreement by taking out a second mortgage on land owned by West 32 without the Daly Parties’ consent, (2) Edgerock and Dalton had breached their fiduciary duty to West 32, (3) Edgerock and Dalton had converted West 32 property when it encumbered the real estate, and (4) Edgerock and Dalton had defrauded the Daly IRA by making false representations related to a Crew Carwash project. The Dalton Parties also contend that the trial court improperly awarded the Daly Parties attorney’s fees and/or treble damages pursuant to the Indiana Crime Victims Relief Act.
