Jeffrey C. Haney, Personal Representative of the Estate of Verda Haney (“the Estate”) appeals from the trial court’s order granting summary judgment in favor of Honeywell International, Inc. (“Honeywell”) and Mary Kay, Inc. (“Mary Kay”).  This case involves a complaint filed by Verda Haney (“Verda”), who is since deceased, against multiple defendants, alleging that the defendants’ use of asbestos-containing products harmed Verda by contributing to Verda’s mesothelioma.  Both Honeywell and Mary Kay, along with other defendants, moved for summary judgment, and the trial court granted the motions filed by Honeywell and Mary Kay.  On appeal, the Estate initially argues that the trial court erred in granting summary judgment because it relied on certain affidavits submitted by Honeywell and Mary Kay that did not comply with Indiana Trial Rule 56(E).  The Estate also contends that the trial court erred in its summary judgment determination because Honeywell and Mary Kay failed to affirmatively negate an essential element of the Estate’s claims, which it claims is required under the Indiana summary judgment standard and because genuine issues of material fact existed as to whether Verda was exposed to asbestos-containing products and whether those products caused her mesothelioma.
