DESCRIPTION:Jeffrey C. Haney\, Personal Representative of the Estate of Ver
 da Haney (“the Estate”) appeals from the trial court’s order grantin
 g summary judgment in favor of Honeywell International\, Inc. (“Honeywel
 l”) and Mary Kay\, Inc. (“Mary Kay”).  This case involves a complain
 t filed by Verda Haney (“Verda”)\, who is since deceased\, against mul
 tiple defendants\, alleging that the defendants’ use of asbestos-contain
 ing products harmed Verda by contributing to Verda’s mesothelioma.  Both
  Honeywell and Mary Kay\, along with other defendants\, moved for summary 
 judgment\, and the trial court granted the motions filed by Honeywell and 
 Mary Kay.  On appeal\, the Estate initially argues that the trial court er
 red in granting summary judgment because it relied on certain affidavits s
 ubmitted by Honeywell and Mary Kay that did not comply with Indiana Trial 
 Rule 56(E).  The Estate also contends that the trial court erred in its su
 mmary judgment determination because Honeywell and Mary Kay failed to affi
 rmatively negate an essential element of the Estate’s claims\, which it 
 claims is required under the Indiana summary judgment standard and because
  genuine issues of material fact existed as to whether Verda was exposed t
 o asbestos-containing products and whether those products caused her mesot
 helioma. \n\nThe scheduled panelists are Chief Judge Tavitas\, Judge Weiss
 mann\, and Judge Foley.
