Joseph Johnson (“Johnson”) appeals his Level 3 felony armed robbery conviction.  The State had alleged that Johnson, while armed with a deadly weapon, had taken cash from a grocery store in Marion County.  The jury found Johnson guilty, and the trial court sentenced him to twelve years in the Indiana Department of Correction.

During Johnson’s jury trial, the State moved to admit security camera videos that had been recorded by the cameras in the grocery store.  Johnson objected based on a lack of foundation, and the trial court overruled the objection and admitted the videos into evidence.

On appeal, Johnson argues that:  (1) the trial court abused its discretion by admitting the security camera videos into evidence because there was a lack of foundation for the videos; and (2) there is insufficient evidence to support his robbery conviction.  The State argues that:  (1) the videos were properly admitted under the silent witness theory; and (2) the evidence is sufficient to support Johnson’s conviction.

The scheduled panelists are Judge Pyle, Judge Kenworthy, and Judge Felix.
