On December 19, 2022, Arthur Moore was involved in a single-car accident.  When first responders removed Moore from the car, they found a handgun in his seat.  At the time, Moore had pending Level 6 felony charges for sexual battery, dealing in marijuana, and maintaining a common nuisance.  After Moore’s accident, the State charged him with Class A misdemeanor unlawful carrying of a handgun.  Moore filed a motion to dismiss the handgun charge, arguing the restriction on his ability to lawfully carry a handgun while “under indictment” violated his constitutional rights under the Second Amendment to the United States Constitution and Article 1, Section 32 of the Indiana Constitution.  The trial court denied Moore’s motion and later found him guilty as charged.  On appeal, Moore again argues the restriction violates his constitutional rights to bear arms under both the Federal and Indiana Constitutions.
