Zachary Fix appeals following his convictions of Level 2 felony burglary while armed with a deadly weapon, Level 5 felony robbery, and Level 6 felony theft. During the early morning hours of July 7, 2017, Fix and an accomplice decided to burglarize the home of a bedridden man, and they entered the home without carrying any weapons. At some point, Fix turned his flashlight away from the victim, and the victim pointed a gun at Fix. Fix then wrestled the gun from the victim and hit the victim over the head with it. Fix raises four issues: (1) whether the State presented sufficient evidence to support Fix’s conviction of burglary while armed with a deadly weapon; (2) whether the trial court abused its discretion by giving the State’s proposed jury instruction regarding the definition of “armed;” (3) whether Fix’s multiple convictions violate the Indiana Constitution’s prohibition against double jeopardy; and (4) whether the trial court’s imposition of consecutive sentences was authorized by law.
