https://mycourts.in.gov/Arguments/Default.aspxDaimon Harris appeals following his convictions of Level 2 felony dealing in cocaine, Level 2 felony dealing in methamphetamine, and Level 4 felony unlawful possession of a firearm by a serious violent felon. Harris lived in a two-bedroom house with two other individuals when officers raided the house and found drugs and paraphernalia inside. At trial, Harris objected when the State offered a photograph of a document that identified Harris as a probationer. The trial court ordered the photograph to be redacted and admitted the redacted version of the photograph. During the State's closing argument, the State displayed an unredacted version of the photograph. The trial court admonished the jury to disregard the unredacted photograph but denied Harris's motion for mistrial. Harris presents three issues for our review: (1) Whether the State presented sufficient evidence that the drugs and paraphernalia the officers found belonged to Harris? (2) Whether the trial court abused its discretion in admitting the redacted version of the photograph? (3) Whether the trial court abused its discretion in denying Harris's motion for mistrial?
The scheduled panelists are Judge Bailey, Judge May, and Judge Foley
