Police officers encountered Mindy Stephens at the site of a one-vehicle auto accident. After speaking with Stephens, an officer filed a probable cause affidavit requesting a search warrant to have Stephens’ blood drawn and tested. A magistrate issued the search warrant. The State later charged Stephens with several offenses, including operating a vehicle while intoxicated in a manner endangering a person. Stephens moved to suppress the results of the blood draw and related evidence, arguing the officer had omitted materially important information from the probable cause affidavit. The trial court denied Stephens’ motion to suppress, and Stephens pursued this interlocutory appeal.
The scheduled panelists are Judge Robb, Judge Crone, and Judge Kenworthy.
