Appellant-Defendant Peggy Sue Higginson was charged with murdering her husband.  Higginson filed her notice of intent to raise a claim of self-defense and introduce effects-of-battery evidence and retained Dr. Polly Westcott as her expert witness.  On interlocutory appeal, Higginson argues that the trial court erred in excluding Dr. Westcott’s testimony concerning Peggy’s PTSD as it should be admissible as effects-of-battery evidence to support a claim of self-defense.

The scheduled panel members are Chief Judge Bradford, Judge Robb, and Judge Altice.
