The State of Indiana charged Tina Isley with operating a vehicle while intoxicated leading to death. Isley seeks to suppress the evidence of her intoxication by arguing that she improperly advised and invalidly consented to a blood draw while receiving medical treatment. The trial court denied her motion to suppress. In this interlocutory appeal, Isley argues that the evidence collected while she was receiving medical treatment is an unconstitutional search under both Article I, Section 11 of the Indiana Constitution and the Fourth Amendment of the United States Constitution.
