Prior to the 2019-2020 collegiate school year, Westwood One Radio Networks, LLC (“Westwood One”) entered into a multi-year contract with the National Collegiate Athletic Association (“NCAA”) and NIT, LLC, to be the exclusive radio home of collegiate athletic championships, including the Division I Men’s Basketball tournament. After the NCAA canceled the 2020 tournament, Westwood One failed to meet its financial obligation pursuant to the parties’ contract. Competing lawsuits were filed, the NCAA threatened to void the remaining years on the parties’ contract, and Westwood One requested injunctive relief to stop the NCAA from voiding the parties’ contract. The trial court denied Westwood One’s request for injunctive relief, finding that Westwood One had failed to satisfy its burden of showing that such relief was warranted. On appeal, Westwood One contends that the trial court erred in concluding that it was not entitled to preliminary injunctive relief.
