COMMISSION ORDER
The Alcohol and Tobacco Commission (Commission) had a revocation hearing on the above captioned certificates. Certificate holder, by counsel, responded to the Commission’s concerns, presenting witnessing.
Certificate holder submitted Notice of Relinquishment of Tobacco Sales Certificate for TC1778001 and TC1778000. The Commission accepts this relinquishment and orders that certificate holder not reapply for this location and truthfully and honestly answer questions relating to distance from a church or school in the future.
Certificate holder presented evidence that it is selling TC15568001 and the sale is scheduled to close on June 15, 2026. Certificate holder presented evidence that it is selling TC16485001 and the sale is scheduled to close on June 30, 2026.
The Commission ordered that:
1.Certificate holder shall proceed with the sale of TC15568001 and TC16485001;
2.Certificate holder shall submit a corrective action plan to the Commission on or beforeJuly 10, 2026, demonstrating the policies and procedures the certificate holderimplemented to ensure compliance with IC 7.1-3-18.5-9, a certificate holder shallexercise due diligence in the supervision and training of the certificate holder'semployees or agents in the handling and sale of tobacco products and electroniccigarettes on the holder's retail premises.3.Certificate holder shall appear for a follow up hearing on July 28, 2026, at 1:00 p.m.(Eastern) to present the corrective action plan.
4.Certificate holder shall maintain strict compliance with Title 7.1 and Title 35 of theIndiana Code and Title 905 of the Indiana Administrative Code.
THEREFORE, you are ordered to appear before the commission in Room E114, at the Indiana Government Center South, 302 W Washington Street, Indianapolis, Indiana 46204 at 1:00 pm (Eastern) on the 28th day of July, 2026 or via Microsoft Teams at:
