Andrew Nemeth sued the Panzica brothers, alleging they breached an oral agreement and were unjustly enriched by excluding Nemeth from an LLC they formed. The Marshall Circuit Court granted summary judgment for the Panzicas on the breach of contract claim and entered judgment for the Panzicas following a bench trial on Nemeth’s unjust enrichment claim. The Court of Appeals reversed, concluding summary judgment was improper and determining Nemeth was entitled to a jury trial on his unjust enrichment claim. Andrew Nemeth Props. v. Panzica, 234 N.E.3d 183 (Ind. Ct. App. 2024), vacated. The Indiana Supreme Court has granted a petition to transfer and assumed jurisdiction over the case.
