Four Indiana cities sued multiple streaming services in Marion County Commercial Court for failing to obtain a franchise and pay a fee under the Video Service Franchises Act. While the case was pending, the General Assembly amended the VSF Act. Over the cities’ argument that the legislation violated the Indiana Constitution, the trial court granted the streaming services’ motion to dismiss based on new legislation. The cities appealed, but the Court of Appeals affirmed, finding no constitutional violation. City of Fishers, v. Netflix, Inc., 264 N.E.3d 69 (Ind. Ct. App. 2025). The cities have petitioned the Indiana Supreme Court to accept jurisdiction over the appeal.
