Edgerock Development bought land and divided it into five parcels. It sold two of them to ZPS with the caveat that Edgerock be retained to develop the lots. Edgerock contracted with C.H. Garmong & Son, which subcontracted with Fox Contractors. Edgerock fell behind on payments to the contractors, so the contractors filed mechanics liens on each of the five lots for the full amount of the work done on all five lots. After the bench trial, the Hamilton Superior Court entered personal judgments against EdgeRock and ZPS as well as judgments in rem against each parcel of land for the full amount owed to the contractors. The CoA affirmed in part and reversed in part, finding that the contractors’ liens were invalid and overstated. Edgerock Dev., LLC v. C.H. Garmong & Son, Inc., 227 N.E.3d 907 (Ind. Ct. App. 2024), vacated. The Indiana Supreme Court has granted the petitions to transfer of C.H. Garmong and Fox and assumed jurisdiction over the case.
