Mt. Zion’s Loving Day Care Ministry petitioned for judicial review after an administrative law judge terminated Mt. Zion from the Child and Adult Care Food Program. The Hamilton Superior Court found that Mt. Zion was willing and able to comply with the program requirements and ordered the Department of Education to reinstate Mt. Zion. But the Court of Appeals reversed, finding the Department did not abuse its discretion. Ind. Dep’t of Educ. v. Mt. Zion’s Loving Day Care Ministry, 273 N.E.3d 418 (Ind. Ct. App. 2025), vacated. The Indiana Supreme Court has granted Mt. Zion’s transfer petition and assumed jurisdiction over the case.
