The Bowens’ 2017 divorce agreement entitled Jackie to a portion of Mark’s accrued pension benefit valued as of January 2017. In October 2020, Mark entered a deferred retirement option program (DROP), allowing him to accumulate a pension benefit while still working. Upon retiring in September 2023, Mark received a lump sum DROP payment. The Hamilton Superior Court denied Jackie’s petition to hold Mark in contempt for failing to pay her a portion of the DROP payment. The Court of Appeals reversed, finding the agreement encompassed the DROP payment. Bowen v. Bowen, 262 N.E.3d 907 (Ind. Ct. App. 2025), trans. pending. Mark has petitioned the Indiana Supreme Court to accept jurisdiction over the appeal.
