Within two months, Delores Taylor recorded two deeds conveying interest in her Allen County farm. The first conveyed interest to all four of her children but contained a faulty legal description; the second fixed the legal description and excluded her son Jay. Meanwhile, she executed a will that expressly excluded Jay from inheriting any interest in the farm. After the farm’s sale failed due to a clouded title, Jay sued his siblings for withholding his portion of farm profits and rents. His siblings counterclaimed, seeking to reform the property’s deed to reflect Delores’s intent to exclude Jay. The Clark Superior Court entered summary judgment for Jay, but the Court of Appeals reversed, concluding the trial court could reform Delores’s unilateral mistake. Jackson v. Jackson, 273 N.E.3d 99 (Ind. Ct. App. 2025), trans. pending. Jay has asked the Indiana Supreme Court to accept jurisdiction over this appeal.
