Bedford Recycling sought conditional use approval to construct a metal recycling facility on land zoned for mineral extraction. Although the Monroe County Board of Zoning Appeals initially approved that conditional use, it later revoked approval, explaining that it made an error of law. The Monroe Circuit Court reversed, but the Court of Appeals found the Board’s revocation was proper. Monroe Cnty. Bd. of Zoning Appeals v. Bedford Recycling, Inc., 241 N.E.3d 1144 (Ind. Ct. App. 2024), trans. pending. Bedford Recycling has petitioned the Indiana Supreme Court to accept jurisdiction over this appeal.
