Ronald McBride sued numerous talcum powder sellers, distributors, and manufacturers alleging asbestos in the talc-powder caused his mesothelioma. The Marion Superior Court denied Missouri manufacturer PTI Union’s and its affiliates’ motions to dismiss for lack of personal jurisdiction because of PTI’s contractual relationship with an Indiana distributor and the volume of talc-powder shipped to Indiana. The Court of Appeals reversed, finding PTI and its affiliates did not do “something more” than put the product into the stream of commerce. PTI Union, LLC v. McBride, 261 N.E.3d 258 (Ind. Ct. App. 2025), vacated. The Indiana Supreme Court has granted transfer and accepted jurisdiction over the appeal.
