The Scotts had been working with the Indiana Department of Environmental Management for over a decade to remediate their contaminated property when Shepard Wrex Management purchased the property in a tax sale. A storm damaged remediation equipment on the property, but Shepard Wrex refused to allow the Scotts entry to repair it. The Scotts sued for an injunction to get access to the property, and Shepard Wrex countersued for trespass, criminal trespass, and an environmental legal action. After a bench trial, the Madison Circuit Court denied the Scotts an injunction but found in the Scotts’ favor on Shepard Wrex’s counterclaims. The Court of Appeals affirmed. Shepard Wrex Mgmt., LLC v. Est. of Betty M. Scott, 272 N.E.3d 224 (Ind. Ct. App. 2025), vacated. The Indiana Supreme Court granted Shepard Wrex’s transfer petition and accepted jurisdiction over the appeal.
