The Cass County juvenile court denied the State’s request to file a delinquency petition as to B.H. because it lacked jurisdiction. B.H. opposed the State’s interlocutory appeal, arguing that (1) the State did not have statutory authority to appeal the juvenile court’s order, and (2) the State’s appeal should be dismissed as untimely. The Court of Appeals disagreed on both issues and reversed. State v. B.H., 245 N.E.3d 170 (Ind. Ct. App. 2024), vacated. The Indiana Supreme Court has granted B.H.’s transfer petition and assumed jurisdiction over the case.
