The State filed two civil suits in Allen Superior Court against TikTok alleging TikTok had violated Indiana’s Deceptive Consumer Sales Act (DCSA). On TikTok’s motion, the trial court dismissed both cases for lack of specific personal jurisdiction and for failure to state a claim. The Court of Appeals reversed, finding Indiana has personal jurisdiction over TikTok and that the State could litigate its DCSA claims. State v. TikTok, Inc., et al., 245 N.E.3d 681 (Ind. Ct. App. 2024), trans. pending. TikTok has petitioned the Indiana Supreme Court to accept jurisdiction over the appeal.
