Tesla employee Kaszuba struck and injured Dugan with a Tesla service truck while turning into a gas station. The Marion Superior Court first granted summary judgment for Dugan and Kaszuba, finding Tesla should be vicariously liable for Kaszuba's negligence. A jury then found Tesla liable for $60M in damages, which it reduced by 30% for Dugan’s comparative negligence. The Court of Appeals affirmed summary judgment and Tesla’s liability but reversed the damages award. Tesla, Inc. v. Norris, 274 N.E.3d 956 (Ind. Ct. App. 2025), vacated. The Indiana Supreme Court has granted transfer and assumed jurisdiction over this case.
