Scott sought post-conviction relief (PCR) after the Indiana Supreme Court issued Doroszko v. State, 201 N.E.3d 1151 (Ind. 2023). The St. Joseph Superior Court denied Scott's petition. On Scott’s appeal, the Court of Appeals reversed the denial of the PCR petition, vacated Scott's conviction and sentence, and remanded for a new trial, holding Scott received ineffective assistance of counsel. Scott v. State, 264 N.E.3d 1214 (Ind. Ct. App. 2025), reh'g denied (Oct. 30, 2025), vacated. The Indiana Supreme Court has granted the State’s petition to transfer and assumed jurisdiction over the case.
