Hamilton pleaded guilty to Level 2 felony dealing in methamphetamine and Level 6 felony operating a vehicle while intoxicated under a plea agreement setting a sentencing cap of twenty years executed. The Elkhart Circuit Court sentenced Hamilton to twenty-five years with six years suspended to probation on the Level 2 felony and a consecutive sentence of one year on the Level 6 felony. Hamilton later filed a petition for post-conviction relief, alleging she received ineffective assistance of counsel at her sentencing. The trial court denied the petition. The Court of Appeals affirmed. Hamilton v. State, No. 20A-PC-641 (Ind. Ct. App. Sept. 17, 2020), vacated. The Supreme Court has granted transfer and assumed jurisdiction over the appeal.
