Plaintiffs, four former directors of a county rural electric membership corporation (“REMC”), sued and argued the REMC breached its contract with them by vacating its longtime policy that had provided qualifying longtime directors post-retirement healthcare benefits. The Clark Circuit Court entered summary judgment for the Plaintiffs on their breach-of-contract claim. A divided Court of Appeals panel affirmed. Clark Cty. REMC v. Reis, 167 N.E.3d 333 (Ind. Ct. App. 2021), vacated. The Supreme Court has granted transfer and assumed jurisdiction over the appeal.
