Four teachers associations and their respective school corporations ratified collective bargaining agreements and submitted them to the Indiana Education Employment Relations Board’s compliance officer. The compliance officer found that each agreement included a provision related to teachers’ ancillary duties that did not comply with statute. The IEERB affirmed the finding of non-compliance and the Marion Superior Court denied judicial review. In a split opinion, the Court of Appeals reversed and remanded with instructions to adopt the agreements in full, holding that the IIERB’s statutory interpretation was unreasonable. Culver Cmty. Teachers Ass’n v. Indiana Educ. Employment Relations Bd., 153 N.E.3d 1130 (Ind. Ct. App. 2020), vacated. The Supreme Court has granted a petition to transfer and assumed jurisdiction over the case.
