Harold Arrendale filed a complaint alleging American Imaging & MRI is vicariously liable for the alleged negligence of the radiologist that read Arrendale’s images. The Allen Superior Court entered summary judgment for American Imaging. The Court of Appeals reversed and remanded, holding Sword v. NKC Hospitals, Inc., 714 N.E.2d 142 (Ind. 1999), applies to a non-hospital facility, specifically, a diagnostic imaging center. Arrendale v. American Imaging & MRI, LLC, No. 20A-CT-2184, -- N.E.3d -- (May 14, 2021), vacated. The Supreme Court has granted transfer and assumed jurisdiction over the appeal.
