Add to calendarMorgan filed a wrongful death claim following the death of his child, and DCS moved for summary judgment and argued Morgan failed to file a timely notice of tort claim (“notice”). The Morgan Circuit Court denied DCS’s motion. Reversing, the Court of Appeals held DCS is entitled to summary judgment because Morgan filed his notice more than 270 days after he had adequate information to file his notice. Indiana Dep’t of Child Servs. v. Morgan, 148 N.E.3d 1030 (Ind. Ct. App. 2020), trans. pending. Morgan has petitioned this Court to accept jurisdiction over the appeal.
