Pursuant to a plea agreement, the Vanderburgh Superior Court sentenced Temme to an executed term of nine years. Due to an error by the Indiana Department of Correction, Temme was released from incarceration with about two-and-a-half years remaining on his executed sentence. After the State filed a motion to re-examine Temme’s credit time, the trial court ordered that Temme serve the remainder of his executed time in prison. The Court of Appeals affirmed. Temme v. State, 158 N.E.3d 423 (Ind. Ct. App. 2020), trans. pending. Temme has petitioned this Court to accept jurisdiction over the appeal.
