Stacey Berg moved to set aside a dissolution decree that incorporates the parties’ mediated settlement agreement, contending the agreement omits a stock account. Russell Berg opposed the motion on grounds the balance sheets Stacey relies on are confidential mediation evidence. The Allen Circuit Court granted Stacey relief. A majority of the Court of Appeals reversed, concluding the balance sheets are inadmissible and that Stacey is estopped from challenging as untrue the agreement’s mutual warranty stating all assets have been disclosed. Berg v. Berg, 151 N.E.3d 321 (Ind. Ct. App. 2020), trans. pending. Stacey has petitioned the Supreme Court to accept jurisdiction over the appeal.
