The Cortezes and the law firm that represented them in a medical malpractice case (“plaintiffs”) filed a second case, one against I.U. Health and its two physical therapists, accusing the therapists of altering medical records and concealing the alterations when testifying about them in the earlier, malpractice case. The Marion Superior Court dismissed the second case, finding both that (1) under the Medical Malpractice Act, the court lacks jurisdiction over the subject matter of the second case and (2) the complaint fails to state a claim on which relief can be granted. The Court of Appeals affirmed. Cortez v. Indiana Univ. Health Inc., 151 N.E.3d 332 (Ind. Ct. App. 2020), trans. pending. The plaintiffs petition this Court to accept jurisdiction over the appeal.
