Add to calendarDiego, charged with child molesting, moved to suppress the recording of his interrogation by police. The Cass Circuit Court granted Diego’s motion, and the State appealed. The Court of Appeals affirmed, finding that the statements were obtained during a custodial interrogation without Miranda warnings. State v. Diego, 150 N.E.3d 715, 721 (Ind. Ct. App. 2020). Rehearing was granted for clarification. State v. Diego, 159 N.E.3d 629 (Ind. Ct. App. 2020). The State has petitioned the Indiana Supreme Court to accept jurisdiction over the appeal.
