After a bench trial in which Spells was found guilty of battery by bodily waste, the Marion Superior Court ordered Spells to pay court costs and a fine as part of her sentence that—when added to a previously imposed supplemental public defender fee—totaled $305. The trial court applied a portion of Spells’s cash bond to this amount, and Spells paid the remaining balance. The Court of Appeals affirmed, holding the trial court did not err in applying the bond amount toward the sums owed and that any issue regarding the remaining balance was moot. Spells v. State, Case No. 22A-CR-1889 (Ind. Ct. App. Apr. 28, 2023), vacated. The Indiana Supreme Court has granted a petition to transfer and assumed jurisdiction over the case.
