Blackford filed a medical malpractice complaint against Wellborn Clinic, which moved for summary judgment on grounds the complaint is time-barred by the Indiana Business Trust Act. Blackford opposed the motion, alleging Welborn’s fraudulent concealment tolled the time to file her complaint. The Vanderburgh Circuit Court entered summary judgment for Wellborn. The Court of Appeals reversed. Blackford v. Welborn Clinic, 150 N.E.3d 687 (Ind. Ct. App. 2020), vacated. The Supreme Court has granted transfer and assumed jurisdiction over the appeal.
