The Griffins filed a premises liability negligence complaint against Menard after Walter Jr. was injured when a sink he was lifting fell out of its box. The Elkhart Superior Court granted summary judgment in Menard’s favor. The Court of Appeals reversed in part, holding that there were disputed questions of fact. Griffin Jr. v. Menard, Inc., 159 N.E.3d 587 (Ind. Ct. App. 2020), vacated. The Indiana Supreme Court has granted a petition to transfer and assumed jurisdiction over the case.
