A jury found Woodward guilty of (1) unlawful possession of a firearm by a serious violent felon, (2) level 5 felony possession of methamphetamine, and (3) the habitual offender enhancement. The Court of Appeals vacated Woodward’s firearm conviction—but left the habitual offender enhancement in place—and remanded for resentencing. On remand, the trial court attached the habitual offender enhancement to Woodward’s level 5 possession of methamphetamine conviction and resentenced Woodward to an aggregate ten-year term. On the second appeal, the Court of Appeals affirmed finding Woodward waived his argument that the possession of methamphetamine sentence should be based on a level 6 felony. The Indiana Supreme Court has granted transfer and assumed jurisdiction over the case.
